AGO to form a taskforce to prepare for implementation of Civil Procedure Code

The Attorney General’s Office (AGO) has revealed plans to form a taskforce to prepare for the implementation of the Civil Procedure Code.

The Civil Procedure Code was ratified by President Ibrahim Mohamed Solih on December 16, 2021. It encompasses the rules relating to pre-trial procedures, proceedings at trial, general rules of evidence applicable to civil cases, judgments, orders, and enforcement of judgments in civil proceedings.

The code will come into effect six months after ratification, which falls on June 16, 2022. The AGO said preparations for the implementation of the code is underway, with programmes to be conducted to familiarise the relevant parties and individuals on the new rules and procedures introduced by the code. The AGO said a taskforce will be formed, comprising of officials from courts and judicial authorities as well as lawyers, to conduct the preparations for the implementation of the code, which also includes formulation of relevant regulations and guidelines under the code.

The purpose of the Civil Procedure Code is to enhance the efficiency of the civil litigation process and to ensure that the cases are decided in a just and transparent manner. The Civil Procedure Code will apply to all courts overseeing civil matters.
